Terms of Use for the Myloc8 subscriptions
Effective Date: 1 February, 2025
Thank you for choosing MyLoc8! Please read these Terms of Use ("Terms") carefully before subscribing to our service. By completing your subscription, you agree to be bound by these Terms, according to the type of subscription plan that you have chosen as detailed below.
If you do not agree, do not proceed with the subscription.
1. Service Description
MyLoc8 ("we," "us," or "our") provides the following location tracking of a GPS-based device, operation of a smartphone app that displays the location of the device and provides alerts, subject to the terms outlined herein.
2. Subscription Term and Commitment
You have chosen one of the proposed Myloc8 subscription plans. The terms of conditions of each plan are as follows:
2.1 The Clubloc8 24-Month Commitment discounted plan:
2.1.1 24-Month Commitment. By subscribing, you agree to a fixed-term commitment of 24 months ("Commitment Period"). You will be billed on a monthly basis for the duration of the Commitment Period.
2.1.2 Early Termination Fee. If you cancel before the end of the Commitment Period, an early termination fee will apply. The termination fee shall be computed as $2.00 for every month remaining until the end of the 24-month commitment period. This fee represents the prorated balance or administrative costs associated with your subscription.
2.1.3 Automatic Renewal Unless you cancel before the end of the Commitment Period, your subscription will automatically renew on a monthly basis at the same rate. You will receive a reminder email 30 days, 14 days and 7 days before the automatic renewal date. After the renewal, you may cancel the subscription at any time with no further commitment.
2.2 The monthly recurring plan:
2.2.1 Monthly billing until cancelled. By subscribing, you agree to be billed monthly. The fixed monthly sum will be charged to the preferred payment method that you have provided once every month and shall continue until you cancel the subscription.
2.2.2 No minimum commitment. You may cancel the subscription at any time. Once cancelled, the next monthly charge will not be billed, and no additional charges will be billed following that. Your service will terminate at the date of the next billing cycle.
2.3 The Yearly plan:
2.3.1 Up-front Yearly billing. By subscribing, you agree to be billed a discounted rate in advance for a continuous subscription period of 12 months. The fixed yearly monthly sum is charged at the time of purchase of the plan.
2.3.2 Automatic Renewal Unless you cancel before the end of the 12 months subscription period, your subscription will automatically renew on an annual basis at the same rate. You will receive a reminder email 30 days, 14 days and 7 days before the automatic renewal date.
2.3.3 Cancellation. You may request cancelation of the automatic yearly renewal. Once cancelled, the following yearly charge will not be billed, and no charges will be billed following that. Your service will terminate at the date of the next billing cycle.
3. Fees and Payment
3.1 Billing You authorize us to charge your preferred payment method on file for subscription fees. Payments are non-refundable except as required by law.
4. Cancellation and Refunds
4.1 Cancellation During the Commitment Period
You may cancel your subscription at any time; however, an early termination fee will apply if the cancellation occurs before the end of the Commitment Period.
4.2 Cancellation After Commitment Period
After the Commitment Period, you may cancel without penalty by providing notice at least 7 days before the next billing cycle.
4.3 How to Cancel
To cancel your subscription you may [1] use the subscription management options in the app, or [2] use the “support” menu on the website, or [3] Email support@myloc8.com with your full details and the Device ID of your Myloc8 device.
5. User Responsibilities
You agree to:
· Provide accurate and complete information during signup.
· Maintain up-to-date payment information.
· Use the service in compliance with all applicable laws and regulations.
6. Changes to the Terms
We reserve the right to update or modify these Terms at any time. Changes will take effect upon posting to our website. If changes significantly impact your rights, we will notify you via email.
7. Dispute Resolution
7.1 Governing Law These Terms are governed by the laws of the state of New York, USA.
7.2 Arbitration Clause Any disputes arising from or relating to these Terms will be resolved exclusively through binding arbitration in accordance with the rules of American Arbitration Association. By agreeing to these Terms, you waive your right to participate in a class action.
8. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of our services.
